Quasi-Judicial Hearing Before the Lincoln County Planning Commission
The Lincoln County Planning Commission will hold a public hearing on Monday, May 18, 2026, at 7:00 p.m., for Case File 01-LUPC-ZC-PC-26, in the Lincoln County Court House, Board of Commissioners’ Conference Room, Public Entrance, located at 225 W Olive Street, Newport, Oregon.
Request for Comprehensive Plan and Zone Change
The applicants, Josheph and Mai Tam, are requesting a Lincoln County Zoning Map change from M-P (Planned Marine) to R-1 (Residential) and an amendment to the Lincoln County Comprehensive Plan Map to remove the Water-Dependent/Water-Related comprehensive plan designation from the subject property. The subject property is within the Kernville Rural Community and, if approved, would remain within the existing Kernville Rural Community boundary.
Location
The subject property is located at 186 Siletz Highway, which is the site of the former Kernville Steakhouse. Also included in the request is the adjacent parcel where the former restaurant septic system is located. The subject property is identified on Lincoln County Assessor’s Map 08-11-11-BA as tax lot 00601 and Map 08-11-02-CC as tax lot 0900.
Hearing Procedure and Testimony
To comply with ORS 192.610-192.690 (Oregon Public Meeting Law) as amended, and the procedures within Lincoln County Code, Chapter 1, this hearing will be conducted both in person and through an online platform (hybrid). The hearing will be livestreamed on Lincoln County's Agendas & Meetings webpage. Opportunity for oral testimony for this hearing will be provided in person at the Lincoln County Courthouse, and through Zoom Webinar, which requires registration at this website. Written testimony submitted in advance of the hearing is encouraged. The Planning Commission chair may limit the time allowed for oral testimony; therefore, parties are strongly encouraged to submit detailed testimony in writing in advance of the hearing. Testimony should be directed to the applicable criteria set forth in this notice or other criteria a party believes apply to the subject request. Failure to raise an issue during the hearing, either in person (including virtually/electronically) or in writing, or failure to provide statements or evidence sufficient to afford the Planning Commission an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals on that issue.
